True, they aren't. However, in the US there is generally a pre-settlement walk-through, where anything that is left behind is considered abandoned property. Different states may have other requirements, though, such as a 7 or 30 day time limit. Most states don't want to judge the issue afterward, since there will typically be little evidence showing ownership. Besides, the vast majority of crap left behind is better off at the dump, and you don't want to burden a buyer with preserving it.
I know that in my state settlement is the cut-off. It can be complicated if you have a squatter, in which case you would have to evict. That doesn't sound like that's the case here.

Yes, karma may be an issue, although not a legal one. I know I'd have a problem keeping an engagement ring or obvious family heirloom, for instance. I'd be pretty upset about finding a couple dozen partially empty paint cans, though.
